The Permitting review will focus on central clauses in the 28(2) permitting regime under the Indian Act and under Land Codes. These include naming the parties, notice, terms of payment, environmental and archeological protections and termination and renewal. Participants will develop a more detailed understanding of the process and the content to be negotiated with various industries and the Crown.
The second part of the course will address development in the case law and best practices on the duty to consult and accommodate First Nation rights and interests. Participants will also prepare template responses to requests for consultation and Consultation Protocol language.
